Terms of Service

These Terms of Service (“Terms”) govern your use of gaugekeep.com and related services (the “Service”), operated by Sundae Software Solutions (“we,” “us”). By accessing or using the Service, you agree to these Terms.

Accounts and access

You are responsible for keeping your sign-in credentials confidential and for activity that occurs under your account. Some data and features are limited to paid plans or to members of a partner organization. Do not share your access with unauthorized parties.

Plans and billing

Paid plans are billed monthly through our payment processor and renew automatically until you cancel. You can change or cancel your plan at any time from the Plans page. Prices are shown on the Plans page before you subscribe, and we will tell you before any price change applies to an existing subscription. Partner organizations are billed under their own written agreement.

Acceptable use

• Do not attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service.
• Do not scrape, resell, or redistribute data from the Service except as expressly permitted.
• Do not use alert recipients or notification contacts to send messages to people who have not agreed to receive them.
• Do not use the Service in violation of any applicable law or regulation.

Data source and accuracy

GaugeKeep decodes and displays telemetry sourced from the U.S. Army Corps of Engineers (DADDS) and the National Oceanic and Atmospheric Administration / National Weather Service. GaugeKeep is an independent service and is not affiliated with or endorsed by any government agency. Readings may be delayed, incomplete, or inaccurate due to sensor faults, transmission gaps, or upstream issues.

Not for life-safety use

The Service is provided for informational purposes only. It is not an emergency-notification system and must not be relied upon as the sole basis for life-safety, evacuation, or flood-response decisions. Always follow official guidance from the U.S. Army Corps of Engineers, the National Weather Service, and local emergency management.

Alerts: email, phone push and voice calls

Alerts are delivered by email, by push notification to devices you enable, and, for partner organizations, by automated voice call. Delivery depends on email, carrier, and device providers outside our control. It is best-effort and can be delayed or fail entirely.

Voice calls are placed only to numbers that a partner organization's administrator adds to its notification list. By adding a number, the administrator confirms that the person has given consent to receive automated alert calls at that number. Anyone who no longer wants calls can ask their organization to remove them or contact us, and we will stop calls to that number. Calls are placed to US numbers only.

Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of data.

Limitation of liability

To the fullest extent permitted by law, Sundae Software Solutions will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from reliance on data provided through the Service.

Changes

We may modify these Terms or the Service at any time. Continued use after changes take effect constitutes acceptance of the updated Terms.
